Terms of Service

1. Acceptance of Terms

By accessing or using the Maritime platform at maritime.sh (the "Service") provided by Maritime AI, Inc. ("Maritime," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and Maritime.

2. Description of Service

Maritime provides a cloud platform for deploying, managing, and monitoring AI agents in containerized environments. The Service includes agent hosting, deployment automation, runtime management, monitoring tools, and related infrastructure. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use the Service, you must create an account by authenticating through a supported provider (Google or GitHub) or other methods we make available. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or legal guardian's consent.

4. Third-Party Authentication

When you sign in using a third-party provider such as Google or GitHub, you authorize us to access basic profile information (name, email, profile picture) from that provider for the purpose of creating and maintaining your account. Your use of third-party authentication is also subject to that provider's terms of service and privacy policy.

You may revoke Maritime's access to your third-party account at any time through that provider's account settings. Revoking access may limit your ability to sign in to the Service.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation
  • Deploy malicious software, malware, or agents designed to cause harm to any system or person
  • Perform unauthorized access to or scanning of third-party systems
  • Engage in cryptocurrency mining or other resource-abusive activities
  • Distribute spam, phishing content, or engage in fraudulent activity
  • Infringe on the intellectual property rights of others
  • Harass, threaten, or harm other users or any person
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to the Service or its related systems
  • Resell or redistribute the Service without our written permission

We reserve the right to suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated these restrictions.

6. Payment and Billing

Certain features of the Service require a paid subscription. By selecting a paid plan, you agree to pay all applicable fees. Key billing terms:

  • Fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by applicable law
  • We reserve the right to change pricing with 30 days' written notice
  • Payment processing is handled by Stripe; their terms also apply
  • Failure to pay may result in suspension or termination of your account
  • You are responsible for all taxes associated with your use of the Service

7. Your Content and Data

You retain all ownership rights to the code, data, configurations, and content you deploy through the Service ("Your Content"). By using the Service, you grant us a limited license to host, store, and transmit Your Content solely for the purpose of providing the Service to you.

You are solely responsible for Your Content and for ensuring it complies with applicable laws. We do not monitor, review, or endorse Your Content. We reserve the right to remove Your Content if it violates these Terms.

8. Intellectual Property

Maritime retains all rights, title, and interest in and to the Service, including all software, infrastructure, documentation, trademarks, and other intellectual property. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without our prior written consent.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free access to the Service. The Service is provided on an "as is" and "as available" basis. We may perform scheduled maintenance, deploy updates, or make modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARITIME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Maritime and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

Either party may terminate this agreement at any time:

  • You may terminate by deleting your account or contacting us at contact@maritime.sh
  • We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with reasonable notice

Upon termination, your deployed agents will be stopped and your data will be deleted after a 30-day retention period, except where longer retention is required by law. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

15. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.

16. Miscellaneous

  • If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect
  • Our failure to enforce any right or provision does not constitute a waiver
  • These Terms constitute the entire agreement between you and Maritime regarding the Service
  • You may not assign or transfer these Terms without our written consent
